class licenses issued under this article may not sell alcoholic
beverages between the hours of 2 a.m. and 6 a.m. on any day of
the week or at any time on Sunday after 2 a.m. However, this
section is subject to the provisions of § 89(j) of this article
regarding sales on New Year's Eve or New Year's Day regardless of
the day of the week on which December 31 and January 1 fall.
(B) (1) IN GARRETT COUNTY, A RESTAURANT THAT IS LICENSED BY
THE BOARD OF LICENSE COMMISSIONERS MAY SERVE ALCOHOLIC BEVERAGES
FOR CONSUMPTION ON THE LICENSED PREMISES ON SUNDAY BETWEEN THE
HOURS OF 1 P.M. AND 12 P.M. IF:
(I) THE ALCOHOLIC BEVERAGE IS SERVED AS A
SUPPLEMENT TO THE MEAL;
(II) THE TOTAL ALCOHOLIC BEVERAGE BILL DOES NOT
EXCEED THE TOTAL PRICE OF THE MEAL;
(III) THE CUSTOMERS ARE SEATED AT A TABLE AND
NOT ON A BAR STOOL OR AT THE BAR;
(IV) THE RESTAURANT ACCOMMODATES THE PUBLIC, IS
FULLY EQUIPPED WITH A PROPER AND ADEQUATE DINING ROOM, AND HAS
SUFFICIENT FACILITIES FOR PREPARING AND SERVING MEALS; AND
(V) THE AVERAGE DAILY RECEIPTS FROM THE SALE OF
FOOD COMPRISE AT LEAST 60 PERCENT OF THE AVERAGE DAILY RECEIPTS
OF THE BUSINESS.
(2) THE ANNUAL LICENSE FEE FOR RESTAURANTS SERVING
ALCOHOLIC BEVERAGES ON SUNDAY UNDER THIS SUBSECTION IS $100 IN
ADDITION TO THE ANNUAL LICENSE FEE FOR THE LICENSE HELD.
SECTION 2. AND BE IT FURTHER ENACTED, That before this Act
becomes effective it shall first be submitted to a referendum of
the legally qualified voters of Garrett County at the general
election to be held in November of 1984. The cost of the special
election, if any, shall be paid by the Board of County
Commissioners. The Board of County Commissioners and the Board
of Supervisors of Elections of Garrett County shall do those
things necessary and proper to provide for and hold the
referendum here required. There shall be printed on the ballots
or ballot labels to be used at this election the title of this
Act and underneath the title, on separate lines, a square or box
to the right of and opposite the words: "For allowing restaurants
in Garrett County to serve alcoholic beverages on Sundays between
the hours of 1 P.M. and midnight " and a corresponding square or
box to the right of and opposite the words "Against allowing
restaurants in Garrett County to serve alcoholic beverages on
Sundays between the hours of 1 P.M. and midnight" so that each
voter of the county may designate his or her decision for or
against the provisions of this Act. If a majority of the votes
