House Bill No. 754

AN ACT concerning

Regional Planning Council - Plans -
Time for Approval

FOR the purpose of altering the time during which the Regional
Planning Council is required to act upon a proposed plan or
development which has been referred to the Regional Planning
Council; and relating to a general development plan
suggested to the Regional Planning Council.

BY repealing and reenacting, with amendments,

Article 78D - Regional Planning Council

Section 17

Annotated Code of Maryland

(1980 Replacement Volume and 1983 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 78D - Regional Planning Council

17.

Whenever the Regional Planning Council has adopted a
suggested general development plan for the regional planning
area:

(1)  No plan or change of plan may be adopted by any
unit of government within the regional planning area, until and
unless the plan has been referred to the Regional Planning
Council for its consideration; and

(2)  No road, park, public way, public building, or
any other development which is metropolitan or regional in nature
or affects an area greater than single unit of government, may be
constructed or authorized in the regional planning area, until
and unless the proposed location and extent thereof has been
referred to the Regional Planning Council for its consideration.

The Regional Planning Council, within [thirty] 60 days after
the receipt or any referral, shall act thereon. Failure to act
within a period of [thirty] 60 days shall constitute its approval
of the proposed plan or development. In case of disapproval, The
