Dear Mr. President:

In accordance with Article II, Section 17 of the Maryland
Constitution, I have today vetoed Senate Bill 955.

This bill permits a law enforcement agency to regulate a law
enforcement officer's secondary employment.

House Bill 915, which was passed by the General Assembly and
signed by me on May 15, 1984, accomplishes the same purpose.
Therefore, it is not necessary for me to sign Senate Bill 955.

AN ACT concerning

Law Enforcement Officers - Regulation of Secondary Employment

FOR the purpose of permitting a law enforcement agency to
regulate a law enforcement officer's secondary employment
for certain purposes.

BY adding to

Article 27 - Crimes and Punishments

Section 729A

Annotated Code of Maryland

(1982 Replacement Volume and 1983 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 27 - Crimes and Punishments

729A.

A LAW ENFORCEMENT AGENCY MAY NOT PROHIBIT SECONDARY
EMPLOYMENT BUT MAY PROMULGATE REASONABLE REGULATIONS AS TO A LAW

ENFORCEMENT OFFICER'S SECONDARY EMPLOYMENT AS NECESSARY TO

PROHIBIT A CONFLICT OF INTEREST IN THE PERFORMANCE OF THE
OFFICER'S OFFICIAL DUTIES.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1984.
