take effect July 1, 1984.

(House Bill 914)

AN ACT concerning

Law Enforcement Officers - Good Samaritan Act

FOR the purpose of providing that a law enforcement officer is
not civilly liable for certain actions taken outside the
officer's jurisdiction to protect life or property in
certain circumstances; and providing for the defense of
officers and certain benefits under certain circumstances.

BY adding to

Article - Courts and Judicial Proceedings

Section 5-309.2

Annotated Code of Maryland

(1980 Replacement Volume and 1983 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Courts and Judicial Proceedings

5-309.2.

(A) A LAW ENFORCEMENT OFFICER ACTING OUTSIDE THE OFFICER'S
JURISDICTION BUT IN THE STATE, IS NOT CIVILLY LIABLE, EXCEPT TO
THE EXTENT THAT HE WOULD BE IF ACTING IN HIS OWN JURISDICTION,
FOR ANY ACT OR OMISSION IN PROVIDING POLICE ASSISTANCE PREVENTING
OR ATTEMPTING TO PREVENT A CRIME, OR IN EFFECTUATING AN ARREST,
IN ORDER TO PROTECT LIFE OR PROPERTY IF:

PRUDENT;

(1) THE ASSISTANCE OR ACTION TAKEN IS REASONABLY

(2) THE ASSISTANCE OR (1) THE ACTION IS NOT GROSSLY
NEGLIGENT; AND

(3) THE ASSISTANCE IS PROVIDED OR (2) THE ACTION IS
TAKEN AT THE SCENE OF AN EMERGENCY THE CRIME OR ATTEMPTED CRIME.

(B) A LAW ENFORCEMENT OFFICER SUED FOR PROVIDING POLICE
ACTING ASSISTANCE UNDER SUBSECTION (A) OF THIS SECTION SHALL BE
