Section 40(h) and 52A(e)

Annotated Code of Maryland

(1981 Replacement Volume and 1983 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows.:

Article 2B - Alcoholic Beverages

14.

(g) (1) There is established in Harford County a six day,
Monday through Saturday, "Class B-l restaurant license" which may
be issued by the liquor control board to bona fide restaurants.
The cost of the license is $225. There is established in Harford
County a seven day "Class B-l restaurant license" which may be
issued by the liquor control board to bona fide restaurants. The
cost of the license is $350. The licensee shall comply with the
food sale requirements of § 2(p) only for the purpose of meeting
the requirements of Section 19(n) necessary to apply for a Class
B restaurant license.

(2)  There is created in Harford County a six day,
Monday through Saturday, "Class B-2 restaurant license." The fee
is $300. There is created in Harford County a seven day "Class
B-2 restaurant license." The fee is $425. These licenses may be
issued by the liquor control board to a licensee who has been
operating his business establishment for one year prior to the
application for the license and who is, in the judgment of the
board, equipped and stocked for the continued regular sale of
food to customers and guests. The licensee need not comply with
the food sale requirement set forth in § 2(p).

(3)  The licenses authorized the licensees to sell for
consumption on [and off] the premises wine and other fermented
beverages as defined in this article with an alcoholic content by
volume of no more than 23% by volume. ["Off-sales"] AS TO ANY
CLASS B-l OR B-2 RESTAURANT LICENSE ISSUED PRIOR TO JULY 1, 1984,
"OFF-SALES" of licensees shall be limited to fermented beverages
including split bottles and brewed beverages in normal
containerized packages; provided that brewed beverages sold in
bottles or cans exceeding 12 ounces in weight or size, for
consumption off the premises, may be sold in a numerical quantity
of less than six. AS TO ANY CLASS B-l OR B-2 RESTAURANT LICENSE
ISSUED ON OR AFTER JULY 1, 1984, "OFF-SALES" BY CLASS B-l AND B-2
LICENSEES ARE PROHIBITED.

[(4) Licensees under this subsection may apply for an
option to their license which is governed by the provisions of
Section 18(o) and Section 19(n).]
