(C) IN THE EVENT THAT SUFFICIENT RECORDS ARE UNAVAILABLE TO
PROVE SERVICE PRIOR TO JANUARY 1, 1974, THE CERTIFICATION MAY BE
MADE BY A UNIT AFTER THOROUGH INVESTIGATION, AND ON THE BEST
INFORMATION, KNOWLEDGE AND BELIEF OF THE BOARD OF DIRECTORS OF
THE INDIVIDUAL'S DEPARTMENT OR SQUAD.
(D) IN THE EVENT FUNDING AS PROVIDED BY § 123(D) OF THIS
ARTICLE IS NOT SUFFICIENT, THE BOARD OF FIRE AND RESCUE
COMMISSIONERS SHALL PROVIDE ADDITIONAL FUNDS TAKEN FROM THE FUNDS
ALLOCATED TO THE VARIOUS FIRE DEPARTMENTS AND RESCUE SQUADS IN
AMOUNTS PROPORTIONATE TO THEIR RECEIPTS FROM THE FIRE AND RESCUE
TAX. IN THE EVENT THAT THE FUNDS PROVIDED FOR RETIREMENT ARE IN
EXCESS OF THE REQUIREMENTS, THE BOARD OF FIRE AND RESCUE
COMMISSIONERS MAY ALLOCATE THESE FUNDS FOR ANY USE AUTHORIZED
UNDER §§ 123 AND 124 OF THIS ARTICLE.
Article 25 - County Commissioners
13A.
In Charles County, the County Commissioners shall administer
the retirement program for volunteer firemen and rescue
squadsmen, as provided for in §§ [126A through 126D] 130 THROUGH
130C of the Code of Public Laws of Charles County.
SECTION 3. AND BE IT FURTHER ENACTED, That the provisions
of Section 123(c) of this Act, relating to the composition of the
membership of the Charles County Board of Fire and Rescue
Commissioners, may not be construed to extend or apply to the
members of the Charles County Board of Fire and Rescue
Commissioners in office on the effective date of this Act, but
the provisions of this Act concerning the composition of the
membership of the Charles County Board of Fire and Rescue
Commissioners shall take effect at the next following terms of
office.
SECTION 3. 4. AND BE IT FURTHER ENACTED, That this Act
shall take effect July June 1, 1984.
