modifications made by the Secretary must be presented to the
Administrative, Executive, and Legislative Review Committee for
review and approval prior to the effective date, and the
Secretary must submit legislation containing these exceptions or
modifications to the next regular session of the General Assembly
following the date on which the exceptions or modifications
become effective.
SECTION -2- 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1984.

AN ACT concerning
Controlled Hazardous Substances--State Hazardous
Substance Fund - Fees - Cleanups - Response Plan
FOR the purpose of §requiring certain generators of controlled
hazardous substances to pay certain fees at certain
intervals; providing for financing of the State Hazardous
Substance Fund; defining certain terms; providing certain
requirements for small quantity generators of controlled
hazardous substances; allowing the Secretary of Natural
Resources Health and Mental Hygiene to perform certain acts
concerning the response authority in the event of a spill or
threatened spill of a controlled hazardous substance;
altering the use of the State Hazardous Substance Fund;
providing for reimbursement in response to a release of
controlled hazardous substances; providing for an emergency
response account; providing for the listing of proposed
controlled hazardous substance sites; providing for certain
criteria for a hazardous substance response plan; providing
for a disposal site registry; prohibiting judicial stays of
certain orders of the Department of Health and Mental
Hygiene to suspend or revoke the permit of a controlled
hazardous substance facility until the exhaustion of certain
judicial appeals concerning the order; and generally
relating to cleanups for controlled hazardous substance
spills in the State and staying of an order to suspend or
revoke a permit of a controlled hazardous substance facility
until the exhaustion of certain judicial appeals.
BY repealing and reenacting, without amendments,
