Ch. 731

INSPECTION OR EXAMINATION FEES FROM PERSONS WHO ARE REGISTERED
WITH LOCAL BOARDS PURSUANT TO LOCAL REQUIREMENTS.

(C)  THIS SUBTITLE DOES NOT LIMIT THE POWER OF
MUNICIPALITIES, CITIES, OR COUNTIES TO ADOPT ANY SYSTEM OF
LICENSES, OR ANY REQUIREMENT OF APPROVAL BY THE MUNICIPALITY,
CITY, OR COUNTY, OF PLANS AND SPECIFICATIONS FOR WORK TO BE
PERFORMED BY CONTRACTORS BEFORE COMMENCEMENT OF THE WORK.

(D)  THIS SUBTITLE MAY NOT BE CONSTRUED TO WAIVE ANY
REQUIREMENTS OF ANY EXISTING OR FUTURE ORDINANCES OR REGULATIONS
OF THE TYPE OF WORK REQUIRED TO BE PERFORMED BY CONTRACTORS UNDER
STATE OR LOCAL BUILDING LAWS.

(E)  PRIOR TO ISSUING A PERMIT, ANY OFFICIAL AUTHORIZED TO
ISSUE ELECTRICAL OR RELATED PERMITS WITHIN THIS STATE SHALL
ASCERTAIN THAT THE ELECTRICAL CONTRACTOR IS DULY QUALIFIED
ACCORDING TO ANY LOCAL REQUIREMENTS IN THE AREA WHERE THE
ELECTRICAL CONSTRUCTION IS TO TAKE PLACE. A VALID STATEWIDE
MASTER ELECTRICAL LICENSE IS ADEQUATE EVIDENCE OF THIS
QUALIFICATION.

(F)  EXCEPT WHERE A STATE MASTER ELECTRICAL LICENSE HAS BEEN
ISSUED BY THE STATE BOARD TO A LICENSEE, WHEN NO LOCAL
EXAMINATION WILL BE NECESSARY, MUNICIPALITIES, CITIES, OR
COUNTIES MAY CONTINUE TO REQUIRE EXAMINATIONS AND LICENSES FOR
ELECTRICAL WORK PERFORMED IN THEIR TERRITORIAL AREA.

(G)  THE RIGHT TO CREATE LOCAL BOARDS IN THE FUTURE BY ANY
MUNICIPALITY, CITY, OR COUNTY WITHIN THE STATE IS PRESERVED.

(H) IF THE BUSINESS IS CONDUCTED UNDER QUALIFIED
SUPERVISION DETERMINED ADEQUATE BY THE BOARD AND ALL REQUIREMENTS
CONCERNING WORKMEN'S COMPENSATION AND INSURANCE ARE COMPLIED WITH
AND THE BOARD IS NOTIFIED WITHIN 10 DAYS BY THE LICENSEE OR AGENT
OF THE BUSINESS OF THE DEATH, ILLNESS, OR PHYSICAL DISABILITY, A
PERSON, FIRM, COMPANY, CORPORATION, OR PARTNERSHIP MAY CONTINUE
TO DO BUSINESS DESPITE THE DEATH, ILLNESS, OR OTHER PHYSICAL
DISABILITY OF THE MASTER ELECTRICIAN WHO QUALIFIED THAT PERSON,
FIRM, COMPANY, CORPORATION, OR PARTNERSHIP FOR A LICENSE. THE
BUSINESS MAY CONTINUE FOR A PERIOD NOT EXCEEDING 120 DAYS
FOLLOWING THE DATE OF DEATH, ILLNESS, OR PHYSICAL DISABILITY.

THIS SUBTITLE DOES NOT APPLY TO:

(1)  EMPLOYEES OF ANY PERSON ENGAGED IN CONTRACTING
WHO ARE SUBORDINATES OF THE PERSON WHO IS LICENSED TO ENGAGE IN
CONTRACTING, IF THE EMPLOYEES DO NOT HOLD THEMSELVES OUT FOR
HIRE, OR ENGAGE IN CONTRACTING EXCEPT AS AN EMPLOYEE;

(2)  (I) ANY POLITICAL SUBDIVISION WHICH DOES NOT HAVE
LICENSING PROVISIONS FOR THIS ACTIVITY OR HAS SPECIFIC PROVISIONS
FOR LICENSING ELECTRICIANS OTHER THAN MASTER ELECTRICIANS, SUCH
AS MASTER LIMITED, MAINTENANCE, OR RESTRICTED ELECTRICIANS.
