SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

9-501.

(c) In addition to any administrative penalty provided in
this title, violation of ANY PROVISION OF ANY PERMIT OR LICENSE
ISSUED UNDER THIS TITLE OR OF any rule or regulation adopted by
any unit within the Department [pursuant to] UNDER the provisions
of this title is a misdemeanor and is punishable as provided in
subsections (a) and (b) of this section.

9-502.

(A)   IN LIEU OF THE STATE PROSECUTING A CRIMINAL ACTION
UNDER ANY PROVISION OF THIS TITLE, THE ATTORNEY GENERAL MAY BRING
A CIVIL ACTION IN THE CIRCUIT COURT AGAINST ANY PERSON WHO
VIOLATES ANY PROVISION OF THIS TITLE OR ANY REGULATION, PERMIT,
LICENSE, OR ORDER ISSUED UNDER THIS TITLE.

(B)  THE CIRCUIT COURT MAY:

(1) FIND THE VIOLATOR LIABLE TO THE STATE FOR A
PENALTY NOT EXCEEDING $5,000 FOR THE VIOLATION; AND

(2) ISSUE AN INJUNCTION REQUIRING THE PERSON TO CEASE
THE VIOLATION AND RESTORE THE AREA UNLAWFULLY DREDGED OR FILLED.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1984.
