AN ACT concerning
Maryland-National Capital Park and Planning Commission -
Sand and Gravel Mining Cases

FOR the purpose of requiring the preparation of an environmental
impact report by the Maryland-National Capital Park and
Planning Commission whenever a request is made for a special
exception to zoning regulations for the mining of sand or
gravel in Prince George's or Montgomery County; specifying
certain subjects to be included in the report; providing for
payment by the applicant of any costs incurred in preparing
the report; and generally relating to special exceptions for
the mining of sand or gravel in Prince George's and
Montgomery counties County.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

(a) A district council, in its zoning regulations, may
provide that the board of zoning appeals or the district council,
or in Montgomery County, an administrative office or agency
designated by the district council, in appropriate cases and
subject to appropriate principles, standards, rules, conditions,
and safeguards set forth in the regulations, may either grant or
deny, upon conditions as may be deemed necessary to carry out the
purposes of this article, special exceptions and variances to the
provisions of the zoning regulations in harmony with their
