LAWS OF MARYLAND

Ch. 657

WHEREAS, The provisions of § 5-106 and of § 5-205(b) are
thus inconsistent; now, therefore,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Estates and Trusts

5-205.

(b) It shall request the grant of letters to the
petitioner, if the petition is filed by all of the persons named
as executors in the will of a testate decedent, or if the persons
IN CLASSES HIGHER IN THE ORDER OF PRIORITY SET FORTH IN § 5-104
OF THOSE entitled to administer the estate of an intestate
decedent join in the petition or consent in writing to the grant.
The joinder or consent of a person who has renounced his right to
administer is not necessary.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1984.

Real Property - Assignment of Mortgages
for Security Purposes

FOR the purpose of simplifying the manner of perfecting security
interests in mortgages; providing certain transitional
rules; providing certain curative provisions; and generally
relating to security interests in mortgages.

BY repealing and reenacting, with amendments,

Article - Real Property

Section 7-101(b)

Annotated Code of Maryland

(1981 Replacement Volume and 1983 Supplement)
