3152                                             LAWS OF MARYLAND                                        Ch. 633

death benefit, or any other right accrued or accruing to any
person under the provisions of this article, and the moneys in
the various funds created by this article, shall not be subject
to execution, garnishment, attachment, or any other process
whatsoever, and shall be [unassignable except as in this article
specifically provided] ASSIGNABLE ONLY IF AND TO THE EXTENT THAT
THE ASSIGNMENT IS EXPRESSLY PROVIDED FOR IN, OR DONE INCIDENT TO,
A COURT DECREE OR ORDER OF DIVORCE, ALIMONY, CHILD SUPPORT, OR A
COURT APPROVED PROPERTY SETTLEMENT INCIDENT TO A COURT DECREE OR
ORDER.

(D) THE BOARD OF TRUSTEES IS NOT LIABLE FOR ANY PAYMENT
MADE TO A WRONGFUL BENEFICIARY IF THAT PAYMENT RESULTS FROM A
FAILURE TO RECEIVE BY THE BOARD OF TRUSTEES WRITTEN NOTICE OF THE
COURT DECREE OR ORDER.

96.

(A)   IN THIS SECTION "COURT" MEANS ANY COURT OF ANY STATE OR
THE DISTRICT OF COLUMBIA.

(B)  THE PROVISIONS OF THIS SECTION SHALL ONLY APPLY TO
PAYMENTS MADE AFTER THE DATE OF RECEIPT OF WRITTEN NOTICE OF THE
DECREE OR ORDER BY THE BOARD OF TRUSTEES, AND OF ANY ADDITIONAL
INFORMATION AND DOCUMENTATION THAT THE BOARD OF TRUSTEES MAY
PRESCRIBE.

(C)  The right of a person to a pension, an annuity, or a
retirement allowance, to the return of contributions, the
pension, annuity or retirement allowance itself, any optional
benefit or death benefit, any other right accrued or accruing to
any person under the provisions of this subtitle, and the money
in the various funds created by this subtitle, shall not be
subject to execution, garnishment, attachment, or any other
process whatsoever, and shall be [unassignable] ASSIGNABLE ONLY
IF AND TO THE EXTENT THAT THE ASSIGNMENT IS EXPRESSLY PROVIDED
