AN ACT concerning
Registration of Retail Service Station Dealers
FOR the purpose of extending an existing conditional moratorium
on the registration of full service retail service stations
that are structurally modified; and clarifying a reference
to certain zoning boards or planning commissioners; and
adding an additional condition that a documentation of
public need be presented to a zoning board or planning
commissioner before structural modification is permitted by
a registered station.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

157F.
(a) (1) Every motor fuel wholesaler, diesel fuel seller,
heating oil distributor, manufacturer, refiner, jobber, and
retail service station dealer before marketing gasoline and
special fuels shall register with the Comptroller of the Treasury
before selling or exposing or offering for sale any gasoline,
other motor vehicle fuels or special fuels and shall register
annually and shall make known to the Comptroller his desire to
sell gasoline and special fuels giving the name and manner and
kind of pump or pumps he will use and the location of same, and
shall keep the certificate or certificates of registration issued
by the Comptroller of the Treasury, posted in a prominent and
accessible place in his place of business where such gasoline and
special fuels are sold. The form of that certificate shall be
designated by the Comptroller of the Treasury. Certificates of
registration may not be issued to retail service station dealers
marketing motor vehicle fuel through retail outlets enlarged,
altered, or structurally modified [(other than as may be required
by appropriate governmental authority) in any way] after July 1,
1977[,] AND before July 1, [1984,] 1988, UNLESS A BONA FIDE
PUBLIC NEED, WHICH MAY BE THE ONLY BASIS FOR CONSIDERATION AND
APPROVAL BY COUNTY, MUNICIPAL, OR SPECIAL ZONING BOARDS OR
PLANNING COMMISSIONERS, IS FULLY DOCUMENTED AND unless the
