Article 21 - Procurement

Section l-202(d)

Annotated Code of Maryland

(1981 Replacement Volume and 1983 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 21 - Procurement

1-202.

(D)(1) THIS ARTICLE DOES NOT APPLY TO EXPENDITURES OR
PROCUREMENT BY A STATE AGENCY WHICH RECEIVES MORE THAN ONE-HALF
OF ITS REGULAR ANNUAL OPERATING EXPENSES FROM A POLITICAL
SUBDIVISION OF THIS STATE.

(2) ANY STATE AGENCY AS DEFINED IN § 1-101(P) OF THIS
ARTICLE, AND ANY OTHER DEPARTMENT, BOARD, COMMISSION, OFFICE,
COURT, BUREAU, OR OTHER AGENCY OF THE STATE GOVERNMENT, WHICH IS
NOT AN EXECUTIVE STATE AGENCY AS DEFINED IN SECTION 1-101(P) OF
THIS ARTICLE, AND WHICH RECEIVES MORE THAN ONE-HALF OF ITS
REGULAR ANNUAL OPERATING EXPENSES FROM A POLITICAL SUBDIVISION OF
THIS STATE, SHALL BE SUBJECT TO THE LAWS, REGULATIONS, AND
PROCEDURES OF THAT POLITICAL SUBDIVISION REGARDING PROCUREMENT,
BUDGETING, AND FISCAL POLICY.

(D) EACH OF THE FOLLOWING ENTITIES IS SUBJECT TO THE BUDGET
AND FISCAL POLICIES AND PURCHASING LAWS OF THE COUNTY IN WHICH IT
IS LOCATED:

(1) ANY COUNTY BOARD OF SUPERVISORS OF ELECTIONS;

(2) ANY STATE'S ATTORNEY'S OFFICE;

(3) ANY SHERIFF'S OFFICE;

(4) ANY COUNTY BOARD OF LIQUOR LICENSE COMMISSIONERS;
OR

(5) ANY CIRCUIT COURT, BUT NOT THE OFFICE OF A CLERK
OF COURT.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1984.
