THERE IS A CHILD SUPPORT ENFORCEMENT ADMINISTRATION IN THE
DEPARTMENT OF HUMAN RESOURCES.

REVISOR'S NOTE: This section formerly appeared as Article
88A, § 59(a).

Defined term: "Support" §§ 1-101 and 10-101

10-107. AUTHORITY OF SECRETARY OF HUMAN RESOURCES.

THE ADMINISTRATION EXERCISES ITS AUTHORITY, DUTIES, AND
FUNCTIONS UNDER ANY LAW OF THIS STATE SUBJECT TO THE AUTHORITY OF
THE SECRETARY OF HUMAN RESOURCES UNDER ANY LAW OF THIS STATE.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first sentence of
former Article 88A, § 59(d).

The former phrase "vested in" is deleted as
unnecessary.

The former phrase "under this section or ... other" is
deleted as included in the phrase "any law of this
State".

The former phrase "Article 41 of the Code or
elsewhere" is deleted as included in the phrase "any
law of this State".

10-108. DUTIES -- IN GENERAL.

(A) COORDINATION OF STATEWIDE PROGRAM.

THE ADMINISTRATION SHALL:

(1)  COORDINATE A STATEWIDE PROGRAM FOR SUPPORT
ENFORCEMENT;

(2)  MAINTAIN A CENTRAL REGISTRY OF RECORDS ON ABSENT
PARENTS AS REQUIRED UNDER § 12-102 OF THIS ARTICLE;

(3)  LOCATE ABSENT PARENTS;

(4)  DETERMINE THE ABILITY OF AN ABSENT PARENT TO PAY
CHILD SUPPORT;

(5)  ACCEPT ASSIGNMENT OF RIGHT, TITLE, OR INTEREST IN
CHILD SUPPORT MADE UNDER ARTICLE 88A, § 48(2) OF THE CODE;

(6)  IN ANY CASE IN WHICH AN ASSIGNMENT IS MADE UNDER
ARTICLE 88A, § 48(2) OF THE CODE, PROSECUTE AND MAINTAIN ANY
LEGAL OR EQUITABLE ACTION AVAILABLE TO ESTABLISH EACH ABSENT
PARENT'S OBLIGATION TO PAY CHILD SUPPORT;
