SUBTITLE 3. REMOVAL OF CHILD FROM STATE; CHILD ABDUCTION.
9-301. DEFINITIONS.

(A)  IN GENERAL.

IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED.

standard introductory language to a definition
section.

(B)  LAWFUL CUSTODIAN.

(1)  "LAWFUL CUSTODIAN" MEANS A PERSON WHO IS
AUTHORIZED TO HAVE CUSTODY OF AND EXERCISE CONTROL OVER A CHILD
WHO IS UNDER THE AGE OF 12 YEARS.

(2)  "LAWFUL CUSTODIAN" INCLUDES A PERSON WHO IS
AUTHORIZED TO HAVE CUSTODY BY AN ORDER OF A COURT OF COMPETENT
JURISDICTION IN THIS STATE OR ANY OTHER STATE.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from former Article 27, §
2A(a), except the final sentence of that subsection.

In paragraph (1) of this subsection, the former phrase
"either alone or together with another person or
persons" is deleted as unnecessary.

Also in paragraph (1) of this subsection, the former
phrase "at the time and place of an act to which any
provision of this section is, or may be alleged to be,
applicable" is deleted as unnecessary.

(C)  RELATIVE.
"RELATIVE" MEANS:

(1)  A PARENT;

(2)  A GRANDPARENT OR OTHER ANCESTOR;

(3)  A BROTHER;

(4)  A SISTER;

(5)  AN AUNT;
