(1)  "EDUCATOR OR SOCIAL WORKER" MEANS ANY
PROFESSIONAL EMPLOYEE OF ANY CORRECTIONAL, PUBLIC, PAROCHIAL OR
PRIVATE EDUCATIONAL, HEALTH, JUVENILE SERVICE, SOCIAL, OR SOCIAL
SERVICE AGENCY, INSTITUTION, OR LICENSED FACILITY.

(2)  "EDUCATOR OR SOCIAL WORKER" INCLUDES:

(I)  ANY TEACHER;

(II)  ANY COUNSELOR;

(III)  ANY SOCIAL WORKER;

(IV)  ANY CASEWORKER; AND

(V)  ANY PROBATION OR PAROLE OFFICER.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from former Article 27, §
35A(b)4.

In paragraph (1) of this subsection, the reference to
a "juvenile service" agency is new language added for
clarity and for consistency with the definition of
"educator or social worker" in § 5-701(c) of this
title.

(E)  HEALTH PRACTITIONER.

"HEALTH PRACTITIONER" INCLUDES ANY PERSON WHO IS AUTHORIZED
TO PRACTICE HEALING UNDER THE HEALTH OCCUPATIONS ARTICLE.

The former references to specific health care
professionals are deleted as unnecessary in light of
the inclusive definition of "health practitioner" and
in light of the provisions of the Health Occupations
Article.

(F)  LAW ENFORCEMENT AGENCY.

"LAW ENFORCEMENT AGENCY" MEANS A STATE, COUNTY, OR MUNICIPAL
POLICE DEPARTMENT, BUREAU OR AGENCY.
