Ch. 296

(A)   IN GENERAL.

IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from the introductory
language of former Article 27, § 35A(b).

(B)  ABUSE.
"ABUSE" MEANS:

(1)  THE SUSTAINING OF PHYSICAL INJURY BY A CHILD AS A
RESULT OF CRUEL OR INHUMANE TREATMENT OR AS A RESULT OF A
MALICIOUS ACT BY ANY PARENT OR OTHER PERSON WHO HAS PERMANENT OR
TEMPORARY CARE OR CUSTODY OR RESPONSIBILITY FOR SUPERVISION OF A
CHILD UNDER CIRCUMSTANCES THAT INDICATE THAT THE CHILD'S HEALTH
OR WELFARE IS HARMED OR THREATENED THEREBY; OR

(2)  SEXUAL ABUSE OF A CHILD, WHETHER PHYSICAL
INJURIES ARE SUSTAINED OR NOT.

REVISOR'S NOTE: This subsection formerly appeared as
Article 27, § 35A(b)7.

In item (1). of this subsection, the words "adoptive
parent", which formerly followed "parent", are deleted
as unnecessary.

Also in item (1) of this subsection, "child" is
substituted for the former words "minor child" in
light of the definition of "child" in subsection (c)
of this section.

The only other changes are in style.

Defined terms: "Child" § 5-901
"Sexual abuse" § 5-901

(C)  CHILD.

"CHILD" MEANS ANY INDIVIDUAL UNDER THE AGE OF 18 YEARS.

REVISOR'S NOTE: This subsection formerly appeared as
Article 27, § 35A(b)2.

The word "individual" is substituted for the former
word "person".

The only other changes are in style.

(D) EDUCATOR OR SOCIAL WORKER.
