(C) (1) Any contract entered into in violation of the
provisions of this section is void.

(2) However, the provisions of this section do not
apply to:

(I)   [any] ANY contract or other transaction
involving the deposit of County funds in any authorized State or
Federal Banking Institution and do not apply to necessary repairs
made in case of emergency[.]; OR [This section does not apply to
the]

(II)  THE purchase of tangible personal property
at a public auction. (1957 Code, sec. 189. 1937, ch. 486, 1941,
ch. 885, sec. 162A; 1951, ch. 121. (See note (7)) 1976, ch. 111;
1977, ch. 146.)

8-24. Aid to manufactories.

(a)  Authorized. [The Board of County Commissioners may,
subject] SUBJECT to the qualifications [herein] set forth IN THIS
SECTION, THE COUNTY COMMISSIONERS MAY NOT spend not more than
[thirty-five thousand dollars ($35,000)] $35,000 annually for the
following purposes:

(1)  To aid and assist any factory in Washington
County engaged in the production of goods essential to the
defense of the State or nation; [or]

(2)  To prevent any factory now located in Washington
County from moving elsewhere because of inducements offered by
any other State, county, or municipality; or

(3)  To aid and assist any factory to become
established in Washington County.

(b)  Use of funds. All money spent [pursuant to] UNDER this
section shall be spent only on property which is either owned in
fee by the County, or leased by the County for a term of at least
[fifteen (15)] 15 years.

(c)  Annual levy. The [Board of] County Commissioners [is
directed to] SHALL provide in each annual levy an amount equal to
the sum to be spent in each year [pursuant to] UNDER this
section. (1957 Code, sec. 190. 1941, ch. 885)

8-25. Commissioners as board of health; health officers.

(A) EACH MAY, OR AS SOON THEREAFTER AS PRACTICABLE, WHEN
SITTING AS A BOARD OF HEALTH, [The] THE County Commissioners [of
Washington County] shall[, when sitting as a local board of
health, annually, in the month of May, or as soon thereafter as
practicable,] appoint a health officer who shall be a
well-educated physician, and who by virtue of such appointment
