This is particularly true as to provisions in this article
that relate to creation and composition of units, appointment of
members, tenure, and vacancies.

In many of the "Membership" sections of this article,
particularly in Title 9, there is a subsection captioned "Tenure;
vacancies". A standard paragraph included in those subsections
provides that a "member who is appointed after a term has begun
serves only for the rest of the term and until a successor is
appointed and qualifies". That paragraph applies: (1) when a
successor is appointed to replace a member who has died,
resigned, or failed for any other reason to complete a term; (2)
when a member is appointed to succeed a member who has "held
over" to part of the next term, pending the delayed appointment
and qualification of the successor; or (3) when, in any other
situation, a member takes office after a term has begun, e.g.,
when, at the completion of a term, there is a delay in the
appointment of a successor, but the member who served the prior
term does not "hold over".

SECTION 2. AND BE IT FURTHER ENACTED, That Section(s) 46
through 47C, inclusive, of Article 40 - General Assembly, of the
Annotated Code of Maryland be transferred, without amendment, to
be Section(s) 2-201 through 2-205, inclusive, of the State
Government Article of the Annotated Code (as enacted by Chapter
____ (S.B. 50) of the Acts of the General Assembly of 1984).

SECTION 3. AND BE IT FURTHER ENACTED, That Section(s) 56B
of Article 40 - General Assembly, of the Annotated Code of
Maryland be transferred, without amendment, to be Section(s) 10A
of Article 15A - Budget and Fiscal Planning, of the Annotated
Code.

SECTION 4. AND BE IT FURTHER ENACTED, That a new Article of
the Annotated Code of Maryland, designated "Political
Subdivisions -- Miscellaneous Provisions", be enacted to read as
follows:

ARTICLE 24 - POLITICAL SUBDIVISIONS -- MISCELLANEOUS

PROVISIONS

TITLE 1. DEFINITIONS.

1-101. DEFINITIONS.

(A) IN GENERAL.

UNLESS THE CONTEXT CLEARLY REQUIRES OTHERWISE, IN THIS
ARTICLE THE FOLLOWING WORDS HAVE THE MEANINGS INDICATED.

REVISOR'S NOTE: This subsection is new language used as the
standard introductory language to a definition
