Former Art. 96, § 40, which was enacted by Ch. 537, Acts of
1920, and which enabled the United States to install a
calibration range in the mouth of the Potomac River and ceded
jurisdiction over the land while the range was maintained, is
deleted as obsolete. Although the United States acquired the
site for use by the Patuxent River Naval Station, the calibration
range no longer exists.
Former Art. 96, §§ 43 through 45, which were enacted by Ch.
296, Acts of 1900, and which provided for the appointment of
agents to prosecute claims that existed against the United States
on or before 1898, are transferred, without amendment, to appear
as Art. 19, §§ 47 through 49 of the Code.
Former Art. 96, § 48, which authorized recoupment of lost
taxes, now appears in Art. 81, § 8A of the Code.
Former Art. 96, §§ 49 through 51, which authorized
participation in various federal projects, are transferred,
without amendment, to appear as Art. 24, §§ 7-201 through 7-203
of the Code.
GENERAL REVISOR'S NOTE TO ARTICLE:
Departmental organization and positions:
Throughout this article, references to current departments,
units, and positions are substituted for obsolete references to
entities that have been abolished or otherwise ceased to exist.
Terminology and standard provisions:
Throughout this article, the term "unit" is substituted for
former references such as "department", "agency", "board", and
"commission", except when a former reference indicated a specific
entity. The term "unit" is used as the general term for an
organization in the State government, because it is broad enough
to include all such entities.
Also throughout this article, for consistency and to avoid
unnecessary confusion, the singular verb "adopt" is used in
relation to rules or regulations and verbs such as "prescribe"
and "promulgate" are deleted. Regulations, in any event, are
subject to the Administrative Procedure Act -- including the
publication and notice requirements of the former State Documents
Law, which are now revised together with the parts of the Act
that relate to regulations. See Title 10, Subtitle 1 of this
article.
It is a precept of the Commission to Revise the Annotated
Code to revise the law in a clear, straightforward manner, and,
once something is said, to say it the same way every time it is
said. To that end, in revising this article, the Commission has
conformed the language and organization of this article to that
of other revised articles, to the extent that the former law
allowed.
