the tidal waters of the State at any time of the year except from
March 1 to April 30 inclusive, which may not be sold or offered
for sale. In any year that the young-of-the-year striped bass
index exceeds 15, the Department may permit by regulation during
the 12 month period beginning April 1 of the following year, the
possession, sale, or offer for sale of striped bass 12 inches in
length.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall

take effect on January 1, 1985, contingent upon the

young of the year striped bass index for 1984 being less than 15;
and if the young of the year striped bass index for 1984 is 15 or
more, this Act shall be null and void without the necessity of
further action by the General Assembly.

SECTION 2. AND BE IT FURTHER ENACTED, That from the
effective date of this Act until June 1, 1984, a person may not
take any striped bass caught from the waters of the Chesapeake
Bay or its tributaries. December 31, 1984, the following
provisions shall be effective:

A. Striped Bass Spawning Areas and Rivers. The following
waters are designated as striped bass spawning areas and rivers.
For the purposes of this special enacting Section, the
designation of a spawning river includes all tributaries to the
river. The lower boundary of the spawning river is the mouth of
the river.

(1) Choptank River;

(2) Nanticoke River;

(3) Patuxent River;

(4) Wicomico River;

(5) Blackwater River;

(6) Pocomoke River;

(7) Transquaking River;

(8) Chester River;

(9) Manokin River;

(10) The Potomac River above the Harry W. Nice
Bridge, other than the area within the jurisdiction of Potomac
River Fisheries Commission; and

(11) That area of the Chesapeake Bay and its
tributaries north of a line drawn from Abbey Point to Worton
Point, including the Sassafras River, the Bohemia River, Elk
