(1) A RECORD OF A UNIT; AND
(2) ANY OTHER PROPERTY THAT IS IN THE POSSESSION OF A
UNIT OR ANY OF ITS MEMBERS OR OFFICERS.
(B) SUCCESSOR.
PROPERTY THAT RELATES TO A TRANSFERRED FUNCTION OR AUTHORITY
OF AN ABOLISHED OR SUPERSEDED UNIT VESTS IN AND SHALL BE
DELIVERED TO THE SUCCESSOR OF THE UNIT.
(C) HALL OF RECORDS COMMISSION.
RECORDS OF AN ABOLISHED OR SUPERSEDED UNIT THAT DO NOT VEST
IN A SUCCESSOR SHALL BE DELIVERED TO THE STATE HALL OF RECORDS
COMMISSION.
(D) BOARD OF PUBLIC WORKS..
OTHER PROPERTY OF AN ABOLISHED OR SUPERSEDED UNIT THAT DOES
NOT VEST IN A SUCCESSOR SHALL BE DELIVERED TO THE BOARD OF PUBLIC
WORKS.
REVISOR'S NOTE: Subsection (a) of this section is new
language added to allow concise reference to the
property of a unit. This addition is based on the
lists of types of property in former Art. 41, § 5.
Subsections (b) and (d) of this section are new
language derived without substantive change from
former Art. 41, § 5.
Subsection (c) of this section is new language derived
without substantive change from former Art. 54, § 6.
This section is revised to reconcile the provisions of
former Art. 41, § 5 and of former Art. 54, § 6 that
related to records. Former Art. 41, § 5 provided for
records to be given to the successor, if any, or to
the Board of Public Works. Former Art. 54, § 6
required records to be given to the Hall of Records
Commission "unless otherwise directed by law" and, in
light of former Art. 41, § 5, could be read to have no
effect. This reading seemed unintended since former
Art. 41, § 5 Last was amended by Ch. 70, Acts of 1939,
while former Art. 54, § 6 was enacted first by Ch. 79,
Acts of 1956, and transferred, without amendment, by
Ch. 344, Acts of 1967. This revision allows the
records to vest in the successor, if any -- as
indicated by former Art. 41, § 5 -- and, in absence of
a successor, to vest in the State Hall of Records
Commission -- as indicated by former Art. 54, § 6.
In subsection (b) of this section, the word
"authority" is substituted for the former enumerations
