In subsection (a) of this section, the power to
"offer" is substituted for the present power "to turn
over ... and deposit", to reflect that the Commission
may decline to take the records.

10-639. NONOFFICIAL MATERIALS.

(A)  IN GENERAL.

AN OFFICIAL OF THE STATE GOVERNMENT MAY OFFER TO THE
COMMISSION OR MAY DESTROY ANY OF THE FOLLOWING MATERIALS THAT THE
OFFICIAL NO LONGER NEEDS:

(1)  A BOOK, MAGAZINE, OR NEWSPAPER;

(2)  OTHER LIBRARY OR MUSEUM MATERIAL THAT WAS MADE OR
ACQUIRED FOR REFERENCE OR EXHIBITION PURPOSES;

(3)  AN EXTRA COPY OF A DOCUMENT THAT WAS KEPT ONLY
FOR CONVENIENCE OF REFERENCE;

(4)  A STOCK OF PUBLICATIONS;

(5)  AN ACCEPTANCE OR REFUSAL OF AN INVITATION OR
ENGAGEMENT OF A PUBLIC OFFICER; AND

(6)  MATERIAL THAT OTHERWISE RELATES TO PERSONAL
BUSINESS OF A PUBLIC OFFICER.

(B)  OTHER MATERIALS.

THE COMMISSION MAY SET CLASSES OF MATERIALS THAT THE
OFFICIAL MAY DESTROY IF THE OFFICIAL NO LONGER NEEDS THE
MATERIALS.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 54, § 9
and the references to "newspapers" and "printed books"
in the first clause of the first sentence of present §
7, as they related to State officials.

In the introductory language of subsection (a) of this
section, the power to "offer" these materials is based
on the specific reference to 2 classes of these
materials in present Art. 54, § 7. The power to
"destroy" these materials is based on the language, in
former Art. 54, § 9, that stated "[f]or the purposes
of § 8, the following types of material shall not be
considered 'records'", which apparently was intended
to permit destruction without the prior written
approval of the Commission.
