Ch. 284

(1)  EXCEPT AS PROVIDED IN PARAGRAPH (2) OR PARAGRAPH
(3) OF THIS SUBSECTION, A NOTICE UNDER THIS SECTION SHALL:

(I)  CONTAIN THE FULL TEXT OF THE REGULATION;
AND

(II)   SHOW EACH CHANGE IN THE TEXT WITH THE
SYMBOLS THAT THE ADMINISTRATOR REQUIRES.

(2)   IF THE TEXT OF THE ADOPTED REGULATION IS THE SAME
OR SUBSTANTIALLY SIMILAR TO THE PROPOSED REGULATION, THE NOTICE
SHALL:

(I)   STATE THAT THE TEXTS ARE THE SAME OR
SUBSTANTIALLY SIMILAR;

(II)  CITE THE DATE OF THE REGISTER IN WHICH THE
PROPOSED REGULATION WAS PUBLISHED; AND

(III)   SHOW EACH CHANGE IN THE TEXT WITH THE
SYMBOLS THAT THE ADMINISTRATOR REQUIRES.

(3)  WITH THE APPROVAL OF THE COMMITTEE, THE NOTICE
MAY CONTAIN A SYNOPSIS OF THE REGULATION IF, WITHIN 90 DAYS AFTER
THE SYNOPSIS IS PUBLISHED, THE FULL TEXT WILL BE PUBLISHED IN THE
PERMANENT SUPPLEMENTS TO THE CODE OF MARYLAND REGULATIONS.

REVISOR'S NOTE: Subsections (a) and (b)(2) and (3) of this
section are new language derived without substantive
change from former Art. 41, § 256F(d) and (e) and the
second and third sentences of § 256D.

Subsection (b)(1) of this section is new language
added to state expressly that which formerly only was
implied by the exceptions in subsection (b)(2) and (3)
of this section and § 10-113 of this subtitle.

Subsection (b)(3) of this section, as revised,
clarifies that the publication of a synopsis applies
only to an adopted regulation. This revision is based
on § 7-205(b) of this article, which limits the
contents of the permanent supplements.

As to the deletion of the first sentence of former
Art. 41, § 256D, which required filing of documents to
be published in the Code of Maryland Regulations, see
revisor's note to § 7-213 of this article.

The fourth sentence of former Art. 41, § 256D, which
exempted certain documents filed before July 1, 1974,
is deleted as obsolete.
