"UNIT" MEANS AN OFFICER OR UNIT AUTHORIZED BY LAW TO ADOPT
REGULATIONS.

REVISOR'S NOTE: This subsection is new language added to
avoid repetition of the phrase "officer and unit" and
the former limitations "authorized by law to adopt"
regulations.

Defined term: "Regulation" § 10-101

10-102. SCOPE OF SUBTITLE.

(A)   IN GENERAL.

EXCEPT AS OTHERWISE EXPRESSLY PROVIDED BY LAW, THIS SUBTITLE
APPLIES TO:

(1)  EACH UNIT IN THE EXECUTIVE BRANCH OF THE STATE
GOVERNMENT; AND

(2)  EACH UNIT THAT:

(I)   IS CREATED BY PUBLIC GENERAL LAW; AND

(II)  OPERATES IN AT LEAST 2 COUNTIES.

(B)  EXCLUSIONS.

THIS SUBTITLE DOES NOT APPLY TO:

(1)  A UNIT IN THE LEGISLATIVE BRANCH OF THE STATE
GOVERNMENT;

(2)  A UNIT IN THE JUDICIAL BRANCH OF THE STATE
GOVERNMENT; OR

(3)  A BOARD OF LICENSE COMMISSIONERS.

REVISOR'S NOTE: Subsection (a) of this section is new
language added to reflect the consolidation, in this
subtitle, of numerous former provisions of the Code
that related to the adoption of regulations. Since
these former provisions contained different
limitations on their scope, this section contains a
consolidated statement of the broadest possible scope.
However, as indicated by the introductory clause of
subsection (a) of this section, "[e]xcept as otherwise
expressly provided by law," the former limitations are
stated expressly in applicable parts of this subtitle.

Subsection (b) of this section is new language derived
without substantive change from former Art. 41, §
256B(c)(2) and the exceptions for the Legislative and
Judicial Branches in § 256B(c)(l) and in the first
sentence of former Art. 41, § 244(a). Although Art.
