In this subsection, the word "regulation" is
substituted, as the defined term, for the former word
"rule", to distinguish, to the extent possible,
between regulations of executive units and rules of
judicial or legislative units and to establish
consistency in the use of these words. This
substitution conforms to the practice of the Division
of State Documents. See, however, revisor's note to §
7-201(h) of this article.

In the introductory clause of paragraph (1) of this
subsection, the word "means" is substituted for the
former word "includes", since the former word did not
seem to apply to the elements set forth in paragraph
(l)(i) through (iii) of this subsection, but rather
seemed to apply only to the form. Thus, in paragraph
(l)(iv) of this subsection, the defined term
"including" is added.

In paragraph (l)(iii) of this subsection, the defined
term "unit" is substituted for the former word
"agency", which had limited application in light of
the definition of that word in former Art. 41, §
244(a). This substitution is consistent with the
incorporation by reference of the definition of
"[r]ule" in former Art. 41, § 256B(f), which defined
the word "rule" for purposes of the State Documents
Law although that Law applied to units that were not
within the former definition of "agency". This
substitution permits the use of the defined term
"regulation" to clarify provisions of the former law
that referred, e.g., to a "rule, regulation, or
standard" without delineating the scope of the
reference.

Also in paragraph- (l)(iii) of this subsection, the
former phrase "whether with or without prior hearing"
is deleted as unnecessary in light of other provisions
of law that specify those instances when a hearing is
required.

In paragraph (l)(iii)l. of this subsection, the former
word "enforced" is deleted as unnecessary in light of
the broad word "administers".

In paragraph (2)(i) of this subsection, the     word

"statement" is substituted for the former     word

"regulations", to conform to paragraph (1) of     this

subsection and to avoid using the defined term   as an
exception to the definition.
