9-928. RESIDENCE IN HOME.

(A)  ADMISSIONS.

IN ACCORDANCE WITH THE REGULATIONS OF THE VETERANS' HOME'
COMMISSION AND APPLICABLE LAW, THE HOME SHALL BE OPEN TO A
VETERAN WHO:

(1)  HAS AN HONORABLE DISCHARGE FROM THE ARMED FORCES;
AND

(2)   IS A RESIDENT OF THE STATE.

(B)  RESIDENCE FEE.

(1)  THE VETERANS' HOME COMMISSION MAY CHARGE AN
INDIVIDUAL A REASONABLE FEE FOR RESIDENCE IN THE HOME.

(2)  THE VETERANS' HOME COMMISSION SHALL SET THE FEE
IN ACCORDANCE WITH THE ABILITY OF AN INDIVIDUAL TO PAY. HOWEVER,
THE FEE MAY NOT EXCEED THE COST OF MAINTAINING THE RESIDENT IN
THE HOME AND SHALL ALLOW THE RESIDENT ENOUGH MONEY FOR NECESSARY
AND INCIDENTAL EXPENSES.

(C)  DISCHARGES.

A RESIDENT MAY BE DISCHARGED IN ACCORDANCE WITH THE
REGULATIONS OF THE VETERANS' HOME COMMISSION AND APPLICABLE LAW.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 96 1/2, §
57 and the second sentence of § 51A.

In subsections (a) and (c) of this section, the
references to "applicable law" are substituted for the
former references to "appropriate State laws" and "any
applicable federal laws, rules and regulations", for
clarity and brevity.

Also in subsection (a) of this section, the former
reference to service in the armed forces "at any time"
is deleted as unnecessary in light of subsection
(a)(1) of this section.
