(4) THE COMMANDANT SHALL:
(I) SERVE AT THE PLEASURE OF THE VETERANS' HOME
COMMISSION; AND
(II) PERFORM ANY DUTY THAT THE VETERANS' HOME
COMMISSION REQUIRES.
(5) IF THE VETERANS' HOME COMMISSION DELEGATES TO THE
COMMANDANT RESPONSIBILITY FOR EMPLOYING STAFF, THE COMMISSION
SHALL HOLD THE COMMANDANT STRICTLY ACCOUNTABLE FOR THE ACTIONS OF
EACH INDIVIDUAL WHOM THE COMMANDANT EMPLOYS.
REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 96 1/2, §
55(a), (c), (f), and (g).
In the introductory language of subsection (a) of this
section, the word "shall" is substituted for the
former ambiguous reference to "powers and duties", for
clarity. In light of this substitution, the third
sentence of former Art. 96 1/2, § 52, which generally
required operation of the Home in accordance with the
regulations, and the former limitation on the
regulations -- "which are not inconsistent with the
intent of this subtitle" -- are deleted as
unnecessary.
In subsection (a)(2) of this section, the former
reference to doing "all things necessary" for the
purpose of supervising the Home is deleted as
surplusage.
Subsection (b)(1) of this section is revised to
clarify that appointment of staff is a power and that
the Veterans' Home Commission may exercise this power
directly. This revision is based on the former
references to the "powers and duties" to "appoint and
employ ... persons needed", which suggested
discretion, and to officials "appointed by them or
under their authority", which indicated that the power
to choose staff need not be delegated to the
commandant. Therefore, in subsection (b)(5) of this
section, the clause "[i]f the Veterans'' Home
Commission delegates ... responsibility for employing
staff" is substituted for the former reference to a
power or duty to "authorize the commandant to appoint
and employ" staff. See also § 9-926(c)(l) of this
subtitle.
In subsection (b)(2) of this section, the former
reference to "election" is deleted since subsection
(b) of this section does not otherwise refer to
elections.
