This section is revised to list duties of the
"Director". This revision reflects that, while former
Art. 41, § 483(d) imposed duties on the "Office of
Minority Affairs", former § 483(c) stated the Director
"shall carry out the duties ... of the Office".

In the introductory language of this section, the
reference to "other units of the Executive Branch of
the State government" is substituted for the former
reference to "other State agencies", to clarify that
the restriction applies to units in the same Branch as
the Office.

In item (l)(i) of this section, the phrase "employment
of minority persons" is substituted for the former
phrase "minority employment", to clarify the scope of
item (l)(i) of this section by use of the defined term
"minority perso[n]".

Similarly, in items (l)(ii) and (2)(i) of this
section, the references to "minority persons and the
communities in which they live" are substituted for
the former references to "citizens in the minority
communities" and "minority citizens and the
communities in which they live". These substitutions
also delete the former word "citizen", which seemed
unintentionally narrow.

Similarly, in item (2)(ii) of this section, the
reference to "any matter that relates to minority
persons" is substituted for the former phrase "matters
that relate to minority affairs".

9-305. MINORITY BUSINESS ENTERPRISES.

(A)  SCOPE OF SECTION.

THIS SECTION APPLIES TO THE FOLLOWING MINORITY BUSINESS
ENTERPRISES:

(1)  A PUBLICLY OWNED BUSINESS IF 1 OR MORE MINORITY
PERSONS OWN AT LEAST 51% OF THE STOCK OF THE BUSINESS; OR

(2)  ANY OTHER BUSINESS IF 1 OR MORE MINORITY PERSONS
OWN AT LEAST 50% OF THE BUSINESS.

(B)  DUTIES.

SUBJECT TO THE LIMITATIONS OF ANY LAW THAT GOVERNS THE
ACTIVITIES OF OTHER UNITS OF THE EXECUTIVE BRANCH OF THE STATE
GOVERNMENT, THE DIRECTOR SHALL:
