REVISOR'S NOTE: This section is new language derived

without substantive change from former Art. 88D, §§

7(a) and (c) and 8(a), (f), (h), and (i) and the
second sentence of § 17.

In subsection (a)(2) of this section, the former
reference to conferring "regularly as necessary or
desirable" is deleted as surplusage.

In subsection (a)(3) of this section, the former
references to "books", "documents", and "files" are
deleted as unnecessary in light of the broad word
"record".

In subsection (a)(6) of this section, the word "total"
is substituted for the former phrase "full and
complete", to conform to § 9-109(c)(2) and (3) of this
subtitle.

9-112. LICENSING.

(A)   IN GENERAL.

IN ACCORDANCE WITH THE REGULATIONS OF THE AGENCY AND THIS
SUBTITLE, THE DIRECTOR SHALL ISSUE LICENSES TO THE PERSONS AND
GOVERNMENTAL UNITS THAT WILL BEST SERVE THE PUBLIC CONVENIENCE
AND PROMOTE THE SALE OF STATE LOTTERY TICKETS OR SHARES.

(B)  CONSIDERATIONS.

BEFORE ISSUING A LICENSE TO AN APPLICANT, THE DIRECTOR SHALL
CONSIDER SUCH FACTORS AS:

(1)  THE FINANCIAL RESPONSIBILITY AND SECURITY OF THE
APPLICANT AND THE BUSINESS OR ACTIVITY OF THE APPLICANT;

(2)  THE ACCESSIBILITY OF THE PLACE OF BUSINESS OR
ACTIVITY TO THE PUBLIC;

(3)  THE SUFFICIENCY OF EXISTING LICENSES TO SERVE THE
PUBLIC CONVENIENCE; AND

(4)  THE VOLUME OF EXPECTED SALES.

(C)   LIMITATIONS.

THE DIRECTOR MAY NOT ISSUE A LICENSE TO:

(1) A PERSON OR GOVERNMENTAL UNIT TO ENGAGE IN
BUSINESS PRIMARILY AS A LICENSED AGENT; OR
