(2) IS ENTITLED TO REIMBURSEMENT FOR REASONABLE
EXPENSES INCURRED IN THE PERFORMANCE OF THE DUTIES AS A MEMBER,
AS PROVIDED IN THE STATE BUDGET.
(E) STAFF.
(1) WITH THE ADVICE OF THE COMMISSION, THE DIRECTOR
MAY EMPLOY DEPUTY DIRECTORS AND OTHER STAFF IN ACCORDANCE WITH
THE STATE BUDGET.
(2) A DEPUTY DIRECTOR MAY BE REMOVED FOR CAUSE AFTER
THE DEPUTY DIRECTOR IS GIVEN:
(I) NOTICE; AND
(II) AN OPPORTUNITY FOR A HEARING.
REVISOR'S NOTE: Subsections (a) and (c) through (e) of this
section are new language derived without substantive
change from former Art. 88D, § 5(d), § 9, and the
first sentence and the second clause of the second
sentence of § 8(b) and the first clause of the first
sentence of (c).
Subsection (b) of this section is standard language
added for clarity.
In subsection (a)(1) of this section, standard
language is substituted for the former clause "[n]o
action ... shall be binding unless taken at a meeting
at which at least three of the five members are
present".
In subsection (c)(2) of this section, the reference to
a "regulation of the Agency" is substituted for the
former reference to "rules adopted by the Commission
or any amendments ... thereof", to standardize the
references to the regulations. See revisor's note to
§ 9-110 of this subtitle.
In subsection (e)(1) of this section, the term "staff"
is substituted for the former reference to
"professional, technical and clerical assistants and
employees", for brevity.
Also in subsection (e)(1) of this section, the power
to employ staff "in accordance with the State budget"
is substituted for the former duties to employ staff
"as may be required to carry out the functions and
duties of the Agency" and "as may be necessary to
perform the duties imposed upon the Agency", which
were misleading since the State budget would control
whether or not a staff member is "required" or
considered "necessary".
