1152                                         LAWS OF MARYLAND                                     Ch. 284

(C) AUTHORITY OF SECRETARY OF STATE.

THE ADMINISTRATOR EXERCISES THE POWERS AND PERFORMS THE

DUTIES UNDER THIS SUBTITLE AND TITLE 10, SUBTITLE 1 OF THIS

ARTICLE SUBJECT TO THE GENERAL SUPERVISION OF THE SECRETARY OF
STATE.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 41, §§
131C and 131D.

In subsection (b)(2) of this section, the word "for"
is substituted for the former phrase "on proof of",
since, under subsection (b)(3)(ii) of this section,
only an opportunity for a hearing is required.

In subsection (b)(3)(i) of this section, the word
"prepare" is substituted for the former word
"brought", as more accurate since the Governor acts
directly, rather than referring the matter elsewhere.

Subsection (c) of this section is revised as a
statement of the supervisory power of the Secretary of
State, for clarity.

Defined terms: "Administrator" § 7-201
"Division" § 7-201

7-204. GENERAL RESPONSIBILITY OF DIVISION AND ADMINISTRATOR.

(A)  COMPILATION AND EDITING.

THE DIVISION SHALL COMPILE AND EDIT:

(1)  THE CODE OF MARYLAND REGULATIONS; AND

(2)  AS A TEMPORARY SUPPLEMENT, THE MARYLAND REGISTER.

(B)  PUBLICATION.

SUBJECT TO THE LIMITATIONS IN THIS SUBTITLE, THE
ADMINISTRATOR IS RESPONSIBLE FOR THE PUBLICATION AND DISTRIBUTION
OF THE CODE OF MARYLAND REGULATIONS AND THE REGISTER.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 41, §§
256F(a) and 256C(a) and all of § 256E except for the
word "prompt".

In subsection (a)(1) of this section, the former
reference to the Code of Maryland Regulations as an
"official legal compilation" is deleted as unnecessary
in light of § 7-217 of this subtitle and as misleading
with respect to documents that are not incorporated
