HARRY HUGHES, Governor                                         1135

TITLE 6. ATTORNEY GENERAL.

6-101. "OFFICE" DEFINED.

IN THIS TITLE, "OFFICE" MEANS THE OFFICE OF THE ATTORNEY
GENERAL.

REVISOR'S NOTE: This section is new language added to avoid
repetition of the full name "Office of the Attorney
General".

6-102. SCOPE OF TITLE.

EXCEPT AS OTHERWISE PROVIDED BY LAW, THIS TITLE DOES NOT
APPLY TO:

(1)  THE PUBLIC SERVICE COMMISSION;

(2)  A BOARD OF SUPERVISORS OF ELECTIONS OF A COUNTY;

(3)  THE BALTIMORE CITY BOARD OF SCHOOL COMMISSIONERS
OR A COUNTY BOARD OF EDUCATION; OR

(4)  ANY OTHER COUNTY OFFICER OR UNIT.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first clause of
former Art. 32A, § 12.

The introductory clause of this section, "[e]xcept as
otherwise provided by law," is added to reflect that,
notwithstanding the broad language of former Art. 32A,
§ 12, this title applies to officers and units who
would be exempted under this section. See, e.g., §
6-107 of this title.

In item (3) of this section, the reference to a county
"board of education" is substituted "for the former
reference to "boards of school commissioners", to
conform to Ed § 3-104(a), which provides that every
county, other than Baltimore City, has a "board of
education".

The second clause of former Art. 32A, § 12, which
enabled county boards and county officers to employ
counsel "as ... authorized by law", is deleted as
unnecessary since the restrictions on employment of
counsel do not apply to county entities and, in any
event, would be superseded by an express authorization
to employ counsel. See § 6-106 of this title.

Defined term: "County" § 1-101

6-103. POSITION; SALARY.
