Ch. 284

(C)  TIMES FOR PUBLICATION.

THE LAW SHALL BE PUBLISHED, IN EACH DESIGNATED NEWSPAPER,
ONCE A DAY ON 3 DIFFERENT DAYS.

(D)  PAYMENT.

(1)   SUBJECT TO THE LIMITATIONS IN THIS SUBSECTION,
THE COMPTROLLER SHALL ISSUE A WARRANT FOR PAYMENT OF THE
PUBLISHER OF A NEWSPAPER, WITHIN 6 MONTHS AFTER THE LAW IS
PUBLISHED IN THAT NEWSPAPER.

(2)  THE AMOUNT THAT IS PAID MAY NOT EXCEED:

(I)  FOR PUBLICATION IN BALTIMORE CITY, $1,200 A
NEWSPAPER; AND

(II)  FOR PUBLICATION IN ANY OTHER COUNTY, $600
A COUNTY.

(3)  (I) ON WARRANT OF THE COMPTROLLER, THE TREASURER
SHALL PAY THE PUBLISHER.

(II) THE TREASURER MAY NOT PAY THE PUBLISHER OF
A NEWSPAPER IK BALTIMORE CITY, UNLESS THE PUBLISHER OR, IF THE
PUBLISHER IS A CORPORATION, 1 OF ITS OFFICERS PROVIDES, WITH THE
WARRANT, AN AFFIDAVIT THAT THE RATE FOR PUBLICATION OF THE LAW
DOES NOT EXCEED THE RATE FOR PUBLICATION OF A LEGAL NOTICE.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 76, §§ 1
through 3.

Subsection (b)(2) of this section is revised to
require designation of "3" newspapers in Baltimore
City. This revision is based on former Art. 76, § 1.
Although former Art. 76, § 2 required a copy to be
sent to the "four" designated newspapers and former
Art. 76, § 3 provided for payment of the "five"
designated newspapers, these former references were
obsolete. The reference, in former Art. 76, § 2, to
"4" papers reflected neither Ch. 329, Acts of 1906,
which increased the publication requirement from 4 to
5 newspapers, nor Ch. 295, Acts of 1922, which
decreased the requirement to 3. Similarly, former
Art. 76, § 3 failed to reflect Ch. 295, Acts of 1922.

In subsection (b)(2) of this section, the former,
specific reference to a newspaper, in Baltimore City,
that "represents the minority political party" is
deleted as obsolete.

In subsection (d) of this section, the reference, in
former Art. 76, § 1, to publication "at the expense of
the State" is deleted as unnecessary in light of the
rest of subsection (d) of this section.
