(B)  RIGHTS, PRIVILEGES, AND BENEFITS.

A PERMANENT PART-TIME LEGISLATIVE EMPLOYEE SHALL RECEIVE
EMPLOYMENT RIGHTS, PRIVILEGES, AND BENEFITS THAT:

(1)  EQUAL AT LEAST 50% OF THE EMPLOYMENT RIGHTS,
PRIVILEGES, AND BENEFITS OF A PERMANENT FULL-TIME EMPLOYEE OF THE
DEPARTMENT OF FISCAL SERVICES OR DEPARTMENT OF LEGISLATIVE
REFERENCE; AND

(2)  FOR AN INDIVIDUAL WHO IS EMPLOYED FOR AT LEAST
50% OF A FULL WORKWEEK, ARE PRORATED IN PROPORTION TO THE NUMBER
OF HOURS WORKED.

(C)  TIME RECORDS.

FOR AUDITING PURPOSES, PERMANENT TIME RECORDS SHALL BE KEPT
FOR EACH PERMANENT PART-TIME LEGISLATIVE EMPLOYEE.

(D)  ADMINISTRATION OF SECTION.

THE PRESIDENT AND THE SPEAKER SHALL ADMINISTER THIS SECTION.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 40, § 4B.

In subsection (a) of this section, the reference to
the "General Assembly" is substituted for the former
reference to "a member of the House ... or the office
of the assistant to the President of the Senate and
Speaker of the House of Delegates, or any division
within that office", since the former reference did
not encompass all of the employees who, in practice,
are covered by this section. This substitution also
deletes the obsolete reference to the Office of the
Assistant to the President of the Senate and Speaker
of the House.

"Speaker" § 2-101

2-1404. LEAVES OF ABSENCES FOR SESSIONS.

WHILE THE GENERAL ASSEMBLY IS IN SESSION, EACH MEMBER OR
EMPLOYEE OF THE GENERAL ASSEMBLY WHO ALSO IS EMPLOYED BY THE
STATE OR ANY OF ITS POLITICAL SUBDIVISIONS:

(1)  IS ENTITLED AUTOMATICALLY TO A LEAVE OF ABSENCE
FROM THE OTHER EMPLOYMENT; AND

(2)  EXCEPT FOR A RIGHT TO A SALARY OR WAGES, MAY NOT
BE DEPRIVED OF OR OTHERWISE HAVE IMPAIRED ANY INCIDENT OF THE
EMPLOYMENT, INCLUDING TENURE, SENIORITY, ANNUAL OR SICK LEAVE,
PROMOTIONAL RIGHTS, OR RIGHTS TO SALARY INCREMENTS.
