SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article - Criminal Procedure
4-101.
(c) (1) Subject to paragraph (2) of this subsection, in addition to any other
law allowing a crime to be charged by citation, a police officer may issue a citation for:
(iv) misdemeanor theft under § 7-104(g)(2) OR (3) of the Criminal
Law Article.
(2) A police officer may issue a citation to a defendant if the officer is
satisfied with the defendant's evidence of identity and reasonably believes that the
defendant will comply with the citation.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 2005.

Dear Mr. Speaker:
In accordance with Article II, Section 17 of the Maryland Constitution, today I have
vetoed House Bill 874 - Alcoholic Beverages - Limited Winery License - Pomace
Brandy.
This bill authorizes holders of a limited winery license to distill and bottle pomace
brandy and to sell and deliver pomace brandy to specified persons under specified
circumstances. This bill also establishes a production limit for distilling and bottling
pomace brandy and defines the term "pomace brandy".
Senate Bill 668, which was passed by the General Assembly and signed by me,
