Governor Senate Bill No. 224 AN ACT concerning Municipal Corporations - Regulation of Nudity and Sexual Displays FOR the purpose of authorizing the legislative body of every each municipal
corporation to adopt an ordinance for the licensing, control, location, or
maintenance within its jurisdiction of a business establishment that allows on
its premises certain activities involving nudity and sexual displays; providing a
certain penalty; and generally relating to the regulation by municipal
corporations of activities involving nudity and sexual displays. BY adding to Article 23A - Corporations - Municipal Section 4A Annotated Code of Maryland (2001 Replacement Volume and 2004 Supplement) SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows: Article 23A - Corporations - Municipal 4A. (A)     THE LEGISLATIVE BODY OF A EACH MUNICIPAL CORPORATION MAY
ADOPT AN ORDINANCE FOR THE LICENSING, CONTROL, LOCATION, OR
MAINTENANCE WITHIN ITS JURISDICTION OF A BUSINESS ESTABLISHMENT THAT
ALLOWS ON ITS PREMISES ANY ACTIVITY INVOLVING NUDITY AND SEXUAL DISPLAYS
LISTED IN ARTICLE 2B, § 10-405(C) THROUGH (F) OF THE CODE. (B)     (1) A PERSON WHO VIOLATES AN ORDINANCE ADOPTED UNDER THIS
SECTION IS GUILTY OF A MISDEMEANOR AND ON CONVICTION IS SUBJECT TO
IMPRISONMENT NOT EXCEEDING 6 MONTHS AND A FINE OF NOT MORE THAN $25
LESS THAN $500. (2) EACH DAY ON WHICH A VIOLATION CONTINUES IS A SEPARATE
OFFENSE. SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
July 1, 2005.
