(F) AN EMPLOYING UNIT THAT KNOWINGLY VIOLATES OR ATTEMPTS TO
VIOLATE ANY PROVISION OF THIS SUBTITLE IS GUILTY OF A MISDEMEANOR AND ON
CONVICTION IS SUBJECT TO IMPRISONMENT NOT EXCEEDING 1 YEAR OR A FINE NOT
EXCEEDING $10,000 OR BOTH.
(G) A PERSON, WHO IS NOT AN EMPLOYING UNIT, WHO VIOLATES, OR
ATTEMPTS TO VIOLATE, OR WHO KNOWINGLY ADVISES AN EMPLOYING UNIT OR A
PROSPECTIVE EMPLOYING UNIT IN A MANNER THAT RESULTS IN A VIOLATION OF
THIS SUBTITLE, IS GUILTY OF A MISDEMEANOR AND ON CONVICTION IS SUBJECT TO
IMPRISONMENT NOT EXCEEDING 1 YEAR OR A FINE NOT EXCEEDING $10,000 OR
BOTH.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall be
interpreted and applied in such a manner as to meet the minimum requirements
contained in any guidance or regulations issued by the United States Department of
Labor.
SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall apply to
the assignment of contribution rates effective on or after January 1, 2006.
SECTION 4. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 2005.
