Ch. 399                                    2005 LAWS OF MARYLAND 17-318. (a) To change the name of a licensee or a firm on a license certificate and pocket
card, a licensee shall submit to the Commission:
(4) a fee [of $5] SET BY THE COMMISSION. Article - Business Regulation 2-106.3. (A)     (1) IN THIS SECTION THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED. (2)      "COMMISSION" MEANS THE STATE REAL ESTATE COMMISSION. (3)      "FUND" MEANS THE STATE REAL ESTATE COMMISSION FUND. (B)     (1) THERE IS A STATE REAL ESTATE COMMISSION FUND IN THE
DEPARTMENT. (2) THE FUND IS A SPECIAL, NONLAPSING FUND THAT IS NOT SUBJECT
TO § 7-302 OF THE STATE FINANCE AND PROCUREMENT ARTICLE. (C)     THE FUND CONSISTS OF FEES COLLECTED BY THE COMMISSION AND
DISTRIBUTED TO THE FUND UNDER § 17-213 OF THE BUSINESS OCCUPATIONS AND
PROFESSIONS ARTICLE. (D)     (1) THE FUND SHALL BE USED TO COVER THE ACTUAL DOCUMENTED
DIRECT AND INDIRECT COSTS OF FULFILLING THE STATUTORY AND REGULATORY
DUTIES OF THE COMMISSION. (2) THE FOLLOWING COSTS MAY NOT BE INCLUDED IN THE DIRECT AND
INDIRECT COSTS OF THE COMMISSION BUT SHALL BE PAID FROM THE GENERAL
FUND OF THE STATE;
(I) THE COSTS OF THE OFFICE OF ADMINISTRATIVE HEARINGS
THAT ARE ATTRIBUTABLE TO CASES REFERRED BY THE COMMISSION; AND
(II) CAPITAL EXPENSES RELATED TO THE IMPLEMENTATION AND
ENHANCEMENT OF ELECTRONIC LICENSING CAPABILITIES.
(E)     THE SECRETARY OR A DESIGNEE OF THE SECRETARY SHALL ADMINISTER
THE FUND. (F)     THE LEGISLATIVE AUDITOR SHALL AUDIT THE ACCOUNTS AND
TRANSACTIONS OF THE FUND AS PROVIDED IN § 2-1220 OF THE STATE GOVERNMENT
ARTICLE. (G)     (1) AT THE END OF EACH FISCAL YEAR, BEGINNING ON JUNE 30, 2006
2007, ANY UNSPENT PORTION OF THE FUND IN EXCESS OF 10% OF THAT YEAR'S
DOCUMENTED DIRECT AND INDIRECT COSTS ATTRIBUTABLE TO THE COMMISSION
SHALL REVERT TO THE GENERAL FUND OF THE STATE.
(2) THE REVERSION OF FUNDS PROVIDED FOR IN PARAGRAPH (1) OF
