(3) prescribing a home visit under subsection (e)(l)(ii) or (2) of this
section. (g) (1) [An] EXCEPT AS PROVIDED IN PARAGRAPH (2) OF THIS SUBSECTION,
AN entity subject to this section may not impose a copayment or coinsurance
requirement or deductible for coverage required under subsection (e)(1) or (2) of this
section or refuse reimbursement under subsection (e)(1) of this section if the services
do not occur within the time specified. (2) IF AN INSURED OR ENROLLEE IS COVERED UNDER A
HIGH-DEDUCTIBLE HEALTH PLAN, AN ENTITY SUBJECT TO THIS SECTION MAY
REQUIRE THAT THE COVERAGE REQUIRED UNDER SUBSECTION (E)(1) AND (2) OF
THIS SECTION BE SUBJECT TO THE DEDUCTIBLE OF THE HIGH-DEDUCTIBLE
HEALTH PLAN. (h) An entity subject to this section shall provide notice annually to insureds
and enrollees about the coverage provided by this section. SECTION 2. AND BE IT FURTHER ENACTED, That this Act is an
emergency measure, is necessary for the immediate preservation of the public health
or safety, has been passed by a yea and nay vote supported by three—fifths of all the
members elected to each of the two Houses of the General Assembly, and shall take
effect from the date it is enacted. Approved May 10, 2005.
CHAPTER 317 (Senate Bill 534) AN ACT concerning Department of Transportation - Personnel - Disciplinary Action FOR the purpose of requiring that certain regulations adopted by the Secretary of
Transportation to govern the Department of Transportation's human resources
management system provide that an appointing authority or a designated
representative of the Department shall initiate certain steps before taking any
disciplinary action related to employee misconduct; requiring the regulations to
authorize the appointing authority or designated representative to suspend an
employee, with or without pay, under certain circumstances; providing that the
regulations shall require the appointing authority or designated representative
to inform the Secretary of Transportation of certain charges within a certain
amount of time if the employee is suspended without pay; providing that the
regulations shall require that an employee be placed on leave with pay for a
certain period of time under certain circumstances; providing that the
regulations shall establish that an appointing authority or a designated
representative and an employee may agree to the holding in abeyance of a
disciplinary action for a certain period of time under certain circumstances; and
generally relating to disciplinary action for Department of Transportation
personnel. - 1595 -
