(House Bill 1696)
AN ACT concerning
Retirement and Pensions - Service Retirement Allowance - Creditable
Service
FOR the purpose of providing that certain members and retirees of the Employees'
Pension System may receive a certain number of years of service credit for
certain employment under certain circumstances; providing for the termination
of this Act; and generally relating to creditable service for purposes of
determining service retirement allowances.
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That:
(a) In this section, "desk officer" means:
(1) the Chief Clerk of the House of Delegates;
(2) the Assistant Chief Clerk of the House of Delegates;
(3) the Journal Clerk of the House of Delegates;
(4) the Secretary of the Senate;
(5) the Assistant Secretary of the Senate;
(6) the Journal Clerk of the Senate; and
(7) any desk officer who retired from the General Assembly on or after
January 1, 2005.
(b) (1) A member or retiree of the Employees' Pension System who has been
employed by the General Assembly as a desk officer on a full-time or part-time basis
may receive up to 5 years of service credit for which the member or retiree is not
otherwise entitled.
(2) Any service credit that a member or retiree of the Employees' Pension
System receives under paragraph (1) of this subsection shall be for the period of time
that the member or retiree:
(i) was employed as a desk officer or in any other position as a
full-time or part-time permanent, temporary, or contractual State employee; and
(ii) was not a member of either the Employees' Retirement System
or the Employees' Pension System.
(3) Except as provided in subsection (c) of this section, for service credit
granted under this Act, a year or part of a year of employment equals 1 year of service
credit.
