ROBERT L. EHRLICH, JR., Governor                             Ch. 572 CHAPTER 572
(House Bill 402) AN ACT concerning Worcester County - Premises Licensed for Alcoholic Beverages Sales - Noise Level FOR the purpose of prohibiting music played on a premises licensed for alcoholic
beverages sales to exceed certain noise level limits in Worcester County or the
noise level limits in the municipal corporation within Worcester County in which
the premises is located; authorizing the Board of License Commissioners to take
certain action if the Board finds a licensed premises in violation of this Act; and
generally relating to premises licensed for alcoholic beverages in Worcester
County. BY repealing and reenacting, with amendments,

Annotated Code of Maryland
(2005 Replacement Volume) SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows: Article 2B - Alcoholic Beverages 12-224.1. (a)     The provisions of this section apply only in Worcester County. (b)     The Board of License Commissioners may regulate the time and noise level
of the playing of mechanical music boxes, live music, and sound making devices that
are used on-licensed premises where the sound disturbs the peace, tranquility, safety,
and health of the surrounding neighborhood. (C)     THE MUSIC PLAYED ON A LICENSED PREMISES MAY NOT EXCEED THE
NOISE LEVEL LIMITS UNDER § ZS 1-327 OF THE CODE OF PUBLIC LOCAL LAWS OF
WORCESTER COUNTY OR THE NOISE LEVEL LIMITS OF THE MUNICIPAL
CORPORATION IN WHICH THE LICENSED PREMISES IS LOCATED. (D)     IF THE BOARD OF LICENSE COMMISSIONERS FINDS A LICENSED
PREMISES IN VIOLATION OF THIS SECTION, THE BOARD MAY: (1)      REQUIRE THE LICENSEE TO ALTER THE TIME THAT THE MUSIC IS
PLAYED; (2)      REQUIRE THE LICENSEE TO REDUCE THE NOISE LEVEL; OR (3)      SUSPEND OR REVOKE THE LICENSE TAKE ANY OTHER ACTION THAT
IS AUTHORIZED UNDER THIS ARTICLE. - 2743 -
