SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That:
(a) This section applies to an individual who:
(1) joined the State Police Retirement System on or before September 1,
1971;
(2) terminated employment with the Maryland State Police on or before
December 30, 1982, and received a refund of the individual's member contributions to
the State Police Retirement System plus interest; and
(3) while working as a State trooper was partnered with an individual
who was shot and killed in the line of duty.
(b) The Board of Trustees for the State Retirement and Pension System shall
accept an application for consideration of a special disability retirement submitted
prior to December 31, 2006, from any individual described under subsection (a) of this
section.
(c) (1) If the Board of Trustees grants an individual described under
subsection (a) of this section a special disability retirement, the individual:
(i) shall pay to the Board of Trustees in a single payment within 6
months of the Board of Trustees granting the special disability, the total refund of
employee contributions plus interest that the individual received on terminating
State employment; and
(ii) is entitled to a special retirement disability benefit as provided
under § 29-110 § 29-111 of the State Personnel and Pensions Article equal to the lesser
of:
1. the individual's average final compensation on December
30, 1982; or
2. the sum of:
A. an annuity that is the actuarial equivalent of the
individual's accumulated contributions at retirement on December 30, 1982; and
B. a pension equal to two-thirds of the individual's average
final compensation on December 30, 1982.
(2) The Board of Trustees shall adjust the allowance of the individual
who receives a special disability retirement allowance under this subsection
retroactively to the date the individual filed the application for special disability
retirement under subsection (b) of this section.
(3) The special disability allowance granted under this subsection shall
include all cost-of-living adjustments from December 30, 1982.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
July 1, 2006.
