found guilty of a violation of this subsection if the person establishes to the satisfaction
of the jury or court sitting as a jury that he used due caution to establish that the
person was not, in fact, underaged. This subsection applies solely to Worcester County
and stands in place and stead of subsection (a)(1), (2), AND (3)(I), (II), AND (IV) of this
section as [the subsection applies] THOSE PROVISIONS APPLY generally to the
counties of this State.
(c) (5) (I) [The] EXCEPT AS PROVIDED IN SUBPARAGRAPH (II) OF THIS
PARAGRAPH, THE provisions of subsection (a) of this section do not apply to the
counties which are listed in paragraph (1) of this subsection and the law in these
counties shall remain in the same force and effect as if not amended by this section.
(II) SUBSECTION (A)(3)(III) OF THIS SECTION APPLIES
THROUGHOUT THE STATE.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 2006.

(House Bill 770)
AN ACT concerning
Emergency Management - Evacuation Emergency Plans for Regulated
Human Service Facilities
FOR the purpose of requiring local organizations for emergency management to
coordinate with certain regulated facilities in the political subdivision to ensure
that the regulated residence has an emergency evacuation plan and that the
local organization has a copy of the plan; requiring local organizations for
emergency management to review the emergency evacuation plans and consult
with certain local agencies and private ambulance services for certain purposes;
and generally relating to emergency management by local organizations for
emergency management requiring certain regulated human service facilities to
develop an emergency plan; specifying the required contents of the plan;
requiring certain State agencies, in consultation with certain human service
facilities and certain State and local emergency management agencies, to adopt
certain regulations; requiring certain human service facilities to provide access
to certain emergency plans to local organizations for emergency management;
defining a certain term; requiring the Governor's Office of Homeland Security to
report to certain committees of the General Assembly on the implementation of
this Act on or before a certain date; requiring certain regulations to include
certain guidelines for the creation of a certain executive summary to be provided
to certain family members on request: requiring the. Department of Health and
Mental Hygiene to consult with certain providers of certain community mental
health residential programs regarding the application of this Act; and generally
