       Lyne 124 perches to the said Halls Land (Viz.t Marshes
       Seat)  Then with the said Halls Lyne East 264 perches to a
       bounded Locust Tree standing by Herring Creek then south forty
       perches then with a Streight Line to the first bounded Tree Containing
       and laid out for 140 acres more or less But a Certain
       Christopher Vernon of Ann Arundell County Gent intruding
       thereinto and keeping your orat.r out of his Lawfull possession
       thereof your orat.r was advised to bring his action at Comon
       Law for Recovery thereof and accordingly by Phillip Duvall
       his Leesee brought Trespass and Ejectment against the said
       Vernon but the probate of the Said Knightons will being
       omitted to be Recorded after a boundance of Charge and
       Trouble was Nonsuited and obliged at great Loss & Charge to
       ^procure an Act of Assembly^ to Confirme the said will after which he again brought
       Trespass and Ejectment in the provinicall Court against
       the said Vernon who haveing Purchased the other Tract
       called Marshes Seat from Thomas Knighton the son and
       Devisee of y.e said Thomas Knighton the father Never regarding
       the Tenour of the Devise afd under which he really purchased
       used such artifice and amusement to the Jury at the Barr to
       perswade them the bounds of Marshes Seat being said to be at
       the head of & with Parkers branch were Naturall & therefore
       Certain whereas in truth not any one Lyne or Course of the
       afd Tract called Marshes Seat really ever Reached to the
       head of Parkers Branch but ran Easterly to herring Creek
       Cross a Small Draught of the afd Branch that they
       Contrary to all right Equity and good Conscience Reason
       brought in their Verdict for the Said Vernon the then Defd.t
       Notwithstanding the Judges sent them out again severall
       times  Wherefore may it please Your Excy in Tender Consideration
       of the premises and that the said Thomas Knighton the Elders
       Will ought and does rule the bounds of the afd two Tracts of
       Lands called Marshes Seat and Gadshill as therein & thereby
       Devised to which the said Vernon was and no Stranger to
