795 So that the whole amount of the said Severall Cargoes by the said Account appears to be Which said Creditt by the said account appears to amount to 1229 17 7 So that by the account afd that the said Arthur Young has over paid the said John Huntt the sum of 106 8 0 Thereupon the Court appoints (by the Consent of both partys) Rob.t Ungle Thomas Robins William Dickinson and Thomas Taylor Comission.rs to Audite and state accounts between the said partys and to make returne thereof to this Court which said Returne follows Viz.t By Virtue of a Comission out of her Majestys high Court of Chancery of this Province Dated at Annapolis the 6.th day of Aprill in the Ninth Year of her Majestys Reigne Annoq Dm 1710 to Impower us or any two of us to Examine and state accounts &c.a Betwixt Richard Bennett Adm.r of John Huntt of Maryland deceased plantiff and Arthur Young Defendant Wee Certifye that having pursuant to the said Comission Caused the said plantiff and Defend.t to appear before us at the Towne and port of Oxford on thursday the first day of March Annoq Dm 1710 and having heard Each of their allegations Wee find the true state of the accounts betwixt to be as followeth Wee find that the said Arthur Young ought not to Charge the Estate of the said John deceased with a protested Bill of Exchange drawne by James Berry for that it was never delivered to the said John Huntt or any person for him which Bill comes to Eight pound Eleaven Shillings the said Arthur has over Charged in his said Account of Accomodations to the said John Huntt Twenty two pound three shillings and Eight pence the said Arthur has Miscast in an Article of seven hundred fifty Nine pound of sugar which he ought to allow for four pound The said Defend.t has further Miscast in an article of 681 Gallons of Rum Twenty Nine pound fourteen shillings Wee further find that the said Arthur has Charged in his Comission more then ought to be allowed him fifty six pound six shillings The said Arthur has Charged the Estate of the said John Huntt with the severall Debts here under written which the said Arthur ought to Answer to the said Deceaseds Estate A Debt due from Sarah Clagett four pound fourteen shillings John Landrick three pound sixteen shillings John Wilson seaventeen pound Eleaven Shillings & six pence Mary Bourne thirteen pound five shillings and six pence John Pardoe (four |
