Provided the Demand in the said action personall and mixt exceed not the sume of six pound ten shillings ster or seventeen hundred pounds of Tobacco and Provided nevertheless that any party or partys plantiffs or Defendants shall be at their liberty on good grounds to bring writts of habeas Corpus and Certiorarie to remove any Plaints from the said Hustings to the Provinciall Courte of this Province and alsoe to appeale from the Judgment of the
