584 M.cnemara directed to Jo.s Wilson gent her Maj.ties Serjeant at vide 3.d Att.a Arms to Attach s.d Tho.s M.cnemara &c w.ch was iss.d Ret y.e 19.th filed of May next * Ane Feb.r 19.th By y.e afd Att y.e s.d Tho.s was taken by y.e afd Serjeant at Arms 1707/8 & y.e s.d prisoner sending a submissive petition to his Exc.cy y.e Gov.r & coming into Courts in Custody of s.d Serjeant at Arms his s.d Pet.n was read & is filed in y.e Office of this Court in these Words To his Exc.cy John Seymour Esq.r Gov.r & Keep.r of y.e great seal of Maryland The humble Pet.n of Tho.s Macnemara Humbly Sheweth That yo.r Pet.r (upon yo.r Exc.cies (by y.e advice of y.e Hon.rble Councill as he humbly perceives) overvaling which has been done on y.e two Habeas Corpuss he has procured in Marg.t Macnemara's Case ag.t him) is now in Custody of Maj.r Jos.a Wilson Sergeant at Arms by virtue of a 3.d precept of y.e high Co.rt of Chanc.ry of this pvince for not obeying yo.r Exc.cies Decree made in her behalf for some Cloaths & Maintenance w.th s.d 3.d Att.a is Ret.ble May next That yo.r Pet.r is now & has offered to Maj.r Wilson his Willingness to Comply with s.d decree in all parts & particulars of y.e same & further to Comply with any Matter or thing y.t can be required of him about y.e premisses to accept whereof he seems unwilling Yo.r Pet.r therefore most humbly desires y.t yo.r Exc.cy will please to ord.r y.e s.d Wilson to discharge him on Complying with such pt of y.e Decree as is at p.rsent to be Complyed with all & if yo.r Exc.cy thinks it proper to charge yo.r Pet.r with any Contempt or fine him therefore y.t yo.r Exc.cy will please to do y.e same now for yo.r Pet.rs Reliefe the C.rt of Chanc.ry (as yo.r Pet.r with submission offers) being allwaies upon And he will ever pray Tho Macnemara After y.e s.d pet.n was in open Court y.e s.d Tho.s declared y.t according to s.d Pet.r he was then willing & ready to Comply with y.e Decretall ord.rs of this C.rt made for Relief of his wife Marg.t afd in all pts & particulars of y.e same & also to pay y.e Costs of suit as well as y.e fifteen pounds p Annum to her his s.d Wife & deliver to her her Cloaths &c in her pet.n desired by y.e hands of y.e sheriff of A A.ll Co.ty Serjeant at Arms afd & thereupon y.e s.d Serjeant at Arms was ordered by his Exc.cy to set free & at large from Custody & Confinem.t y.e s.d Tho.s wch he did forthwith & promised to y.e C.rt to see y.e s.d Tho.s make good what he engaged as afd Ordered also then by y.e Court That upon Reconciliation & Cohabitation of s.d Tho.s & Marg.t his Wife such part or so much of y.e fifteen pounds P Annum as shall be paid before due by y.e decree shall be repaid to him y.e s.d Husband by y.e Wife afd True Copy of y.e proceedings in y.e Minutes of y.e Cause afd see y.e Compl.ts Cost Recorded by Me in pag 585 John Freeman Reg.r in Chanc.ry In |
