535 Rob.t Finley & Wife Jane Comp.lt Decree for y.e Compl.t one of y.e Exec.rs of W Housley ag.t Philemon Housley y.e other Defts Exec.r of s.d W.m Housley An by y.e grace of God of Engl.d Scotl.d France & Irel.d Queen Def.r of y.e faith &c To Philemon Hemsley one of y.e Exec.rs of y.e last Will & testam.t of W.m Hemsley during y.e Minority of his daughter Elizabeth Hemsley Know y.e y.t Whereas Rob.t Finley & Jane his Wife joynt Exec.r w.th y.e s.d Philemon Hemsley (during y.e Minority of Elizabeth Hemsley daughter of W.m Housley) of y.e last Will & testam.t of y.e s.d W.m Hemsley by their bill of Complaint in our high Court of Chancery before our trusty & wellbeloved John Seymour Esq.r our Cap.t Gen.ll & Gov.r of this our Pvince of Maryland & Keep.r of our great seal thereof have amongst other things therein set forth That y.e s.d Jane being constituted by y.e last Will & Testam.t of y.e s.d W.m her former Husband Coexec.rx with his daughter Elizabeth Hemsley then under Age (to execute y.e s.d Will & order thereunto they put y.e estate of y.e [illegible]) y.e s.d Jane by y.e perswasion of Friends & out of y.e intire trust she reposed in her brother in Law Philemon Hemsley was prevailed upon to take him in with her on behalf of his Niece then under Age to execute y.e s.d Will & in order thereunto they got the Estate of y.e s.d W.m Inventoried & appraised & made an æquall division of such part thereof as was then visible & in place And y.t y.e s.d Jane one of y.e Compl.ts delivered unto y.e s.d Philemon all y.e books papers bills bonds & other Writings relating to y.e s.d Estate being y.e fittest Pson & best able to recover such debts as were standing out & due to y.e s.d Estate he then faithfully promising to be accountable to her for y.e one Moiety of all such debts or other pt of y.e Estate as should any ways come to his hands And did farther set forth y.t y.e s.d W.m in his lifetime & at y.e time of his death stood indebted unto One John Hyde of y.e City of London Merch.t in y.e sum of one hund.d & fifty pds st or thereabouts one Moiety whereof ought to have been paid by y.e s.d Philemon inasmuchas he had one Moity of y.e s.d Estate w.ch he refused to comply with all but she would most unjustly throw y.e whole barthen of y.e s.d Debt upon y.e Compl.ts by whose acc.t y.e s.d Jn.o Hyde knowing no other Exec.r of y.e WIll of y.e s.d W.m than y.e Compl.ts had placed y.e same w.ch actings & doings ^of y.e s.d Philemon^ are ag.t Equity Justice & good Conscience And y.e Compl.ts having no relief but in our s.d Court pray.d Relief Remedy for y.e s.d Wrongs for y.e |
